Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and មេឃា about your use of the មេឃា social page, online shop, customer app and related services (the "Service"). By creating an account, tapping Sign up, or using the Service, you agree to these Terms, our Privacy Policy, Cookies Policy and Community Standards, and — if you join the member network — our MLM Policy. If you do not agree, do not use the Service.

2. Who can use the Service

You must be at least 13 years old. If you are under 18, you confirm that a parent or guardian agrees to these Terms for you. You must be 18 or older to join the member network (MLM), receive commissions or withdraw money.

You may not use the Service if we have closed your account before for breaking these Terms, or if the law forbids you from using it.

3. Your account

Use your real name and give true, current information. One person, one account.

Keep your password secret and change the starting password after your first sign-in. You are responsible for everything done with your account; tell us at once if you think someone else is using it.

Staff of មេឃា may reset your password when you ask and confirm who you are.

4. Your content

You own the posts, comments, photos and videos you share ("your content"). By sharing it on the Service you give មេឃា a non-exclusive, royalty-free, worldwide licence to host, store, display, reproduce and share it on the Service, and to show it in promotion of the Service where you shared it publicly. This licence ends when you delete your content or account, except where others have already shared it or the law requires us to keep it.

You confirm you have the rights to everything you share and that it does not break the law, these Terms or the Community Standards. We may remove content or limit its reach when it does.

5. What you must not do

Break the law; post content that is false, misleading, hateful, violent, sexual, harassing, or that infringes anyone's privacy, copyright or trademark; pretend to be someone else; send spam or unsolicited advertising; collect other users' information; try to get into accounts or systems you are not allowed to; interfere with or overload the Service; use bots or scripts without our permission; or help anyone else do these things.

6. Orders, prices and payment

Products, prices, stock and promotions shown on the Service may change and may contain mistakes. An order is accepted only when មេឃា confirms it. If a price or description is wrong, we may cancel the order and refund anything you paid.

You agree to pay the price, delivery charges and taxes shown at checkout. Delivery times are estimates.

Returns, exchanges and refunds follow the shop policies published on the Service and the consumer protection law of the Kingdom of Cambodia.

7. Reward points and member network (MLM)

Reward points, discounts and membership levels have no cash value except as stated in the programme rules, cannot be transferred, and may expire or change as the rules say.

The member network pays commissions only on real purchases of products, as set out in the MLM Policy. There is no payment for recruiting people alone, no fee to join, and no promise of income: what a member earns depends on genuine sales. Commissions may be withheld or reversed for returned orders, fraud or breaking these Terms or the MLM Policy.

8. Our rights and changes to the Service

The Service, its design, software, names and logos belong to មេឃា or its licensors and are protected by law. You may not copy or use them except as the Service allows.

We may change, suspend or stop parts of the Service. We will try to give notice of changes that affect you significantly.

9. Suspension and closing your account

You can close your account at any time from Settings or by asking us.

We may remove content, limit features, or suspend or close your account if you break these Terms, the Community Standards or the law, if you create risk or legal exposure for us or others, or if your account has been inactive for a long time. Where reasonable we will tell you why and how to appeal.

10. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we do not promise it will always be uninterrupted, secure or error-free, and we are not responsible for what other users post or do, on or off the Service.

11. Limitation of liability

To the extent the law allows, មេឃា is not liable for indirect, incidental, special or consequential loss, or for loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the order the claim is about. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

If someone brings a claim against មេឃា because of your content, your use of the Service or your breach of these Terms, you agree to cover the reasonable losses and costs that result, to the extent the law allows.

13. Governing law and disputes

These Terms are governed by the laws of the Kingdom of Cambodia. We will first try to settle any dispute with you in good faith by talking to each other; if that does not work, the dispute will be decided by the competent courts of the Kingdom of Cambodia.

14. Changes to these Terms

We may update these Terms. We will tell you about important changes on the Service before they take effect. If you keep using the Service afterwards, you accept the updated Terms; if you do not agree, you can close your account.

15. General

If any part of these Terms cannot be enforced, the rest stays in force. If we do not enforce a right at once, we do not give it up. These Terms, together with the policies they mention, are the whole agreement between you and មេឃា about the Service. Where the Khmer and English versions differ, the Khmer version prevails.
